Defending Children’s Rights in Sudan (Transitional Justice)

Human rights treaties are an important part of how human rights law is defined and enforced. These treaties are usually attached to a “treaty body”, or a committee responsible for making sure that State Parties comply with human rights. They do this by periodically reviewing countries, as well as accepting communications from individuals whose rights were violated.

PEJ and other organizations filed a communication before an African regional treaty body—the African Committee on the Rights and Welfare of the Child—on behalf of children in Sudan’s Two Areas, who were bombed by al-Bashir’s regime from 2011-2016. The Committee provided two options for how to resolve the case: 1) the Committee could decide whether Sudan violated the children’s human rights and what the remedies are, or 2) we could negotiate an amicable settlement directly with Sudan, under guidance from the Committee, and together agree on the remedies. Given recent developments in Sudan, we chose the latter.
