Universality and Strategic Litigation (Transitional Justice)
Fighting Impunity on the National Level. The host for this show is Jay Fidell. The guest is Federico Thofern.
The episode’s main discussion revolves around the different legal avenues that can be contemplated when prosecuting international crimes. After touching upon the merits and limits of international institutions of international criminal law (ICL), the alternative and promising avenue of national criminal proceedings, initiated on the basis of the jurisdictional principle of universality, is discussed. At this point, the concept of ‘strategic litigation’ is introduced. Reference to current events is an integral part of the discussion (especially the situation in Ukraine).
