Our panel discusses Hawaii v. Christopher Wilson, the recent landmark unanimous decision of the Hawaii Supreme Court effectively rejecting the Supreme Court’s rulings on guns. A brand-new right for guns was created by the US Supreme Court in 2022, a Clarence Thomas’ opinion in New York State Rifle & Pistol Association, Inc. v Bruen. Thomas’ opinion was based on the brand-new individual right to gun possession created by Antonin Scalia’s 2008 decision in Heller v District of Columbia. Williams was an important and courageous decision and a great statement for Hawaii, but what will it mean in the face of Bruen and Heller and the national jurisprudence on gun control now and going forward.
