States and ICC Crimes: who Does What (Transitional Justice)

In this episode, we discuss who is responsible to ensure that justice is done for core international crimes.
The International Criminal Court (ICC) is seen as the jurisdiction responsible for investigating, prosecuting and adjudicating the crimes of genocide, crimes against humanity and war crimes. It is, however, only one piece of a larger system where States play the key role:
Firstly, States bear the primary responsibility for prosecuting international crimes, the ICC jurisdiction is only complementary to the States’.
Secondly, even when a situation is before the ICC, the Court cannot work without State’s full and genuine cooperation.
