How do you get elected?. Richard Emery will be the moderator and I will be the guest and we will discuss the case reported in the Star-Bulletin re the Waiau Condo Board TRO. The issue involved a 2017 change to HRS 514B-107(b), which clarified that a “tenant” could not serve on the Board. The change was made to prevent tenants of corporate owners, who were not representatives or designated employees of the corporation, from serving on the board since their perspective on issues relating to the condo community would not reflect an”owners'” perspective. In the case that was reported, the resident/occupant and his wife were sole owners of the LLC that owned the unit so they clearly represented the corporate owner’s interest on issues affecting the condo community.
