The Treaty on Prohibition of Nuclear Weapons (TPNW) entered into force on January 22, 2021.
The binding international law includes the laws of warfare (UN Charter and international humanitarian law) and human rights law – in particular the Right to Life. The International Court of Justice applied the laws of warfare to nuclear weapons in the 1996 Advisory opinion to affirm that the threat or use of nuclear weapons is generally illegal. The UN Human Rights Committee applied human rights law to nuclear weapons in 2018 to affirm that the threat or use of nuclear weapons is incompatible with the Right to Life. Both the ICJ and the UN Human Rights committee affirmed the legal obligation to achieve the global elimination of nuclear weapons. The TPNW is an initiative by non-nuclear States to implement this law.
